Australasian Lawyer reports on the introduction of Practice Note SC Gen 23 by the NSW Supreme Court, which provides specific guidelines on the use of generative AI in legal practice. Effective from February 3, 2025, the guidelines aim to address risks associated with AI tools, such as generating fictitious case citations or unverified materials in witness statements.

Developed in consultation with the NSW Bar Association and the Law Society of NSW, the practice note mandates that lawyers understand the limitations of AI technologies and take responsibility for their outputs. The guidelines coincide with amendments to the Uniform Civil Procedure Rules and signal a broader effort to adapt Australia’s legal system to evolving AI technologies.

NSW Law Society President Brett McGrath praised the initiative, calling it a critical step in ensuring responsible AI use in legal practice. Judges have also been provided with guidelines to ensure consistent application of AI in courtrooms. The Supreme Court will periodically review the practice note to keep pace with AI advancements.
