According to an article from Paris50Degres, the Chilean government, led by Minister of Science, Technology, Knowledge, and Innovation Aisén Etcheverry, is set to present a new draft law on artificial intelligence (AI) to Congress in May 2024. This legislation differs from previous drafts by implementing a risk-based regulatory framework designed to foster innovation while ensuring AI application safety.
Initiated by President Gabriel Boric, the proposed bill emphasizes incorporating human factors into AI technology deployment, aiming for widespread beneficial outcomes. The framework was discussed in line with global standards at recent OECD meetings. It proposes a classification of AI systems based on risk levels, where high-risk applications face stringent controls, and lower-risk ones have fewer restrictions. This classification aims to encourage technological advancement without compromising public safety.
Additionally, the bill outlines administrative sanctions for non-compliance, enforced by the newly established Data Protection Agency. It also provides for legal remedies in cases of damage or injuries caused by AI systems. Notably, the legislation includes provisions for "sandboxes," or controlled testing environments, which allow startups to experiment with new technologies under regulatory supervision, thus supporting the growth of Chile's technology sector.
