The study argues that traditional theories on legal subjects, which predominantly focus on human-centric perspectives, may be inadequate for addressing AI's unique legal challenges. By examining AI within a legal fiction framework, the study proposes that AI can function as a legal subject, adhering to principles based on human analogies. This approach can optimize efficiency and order within legal systems. However, practical implementations must establish clear boundaries, ensuring AI abides by principles of equality, openness, and scientific legislation. The paper outlines necessary systems, including establishment and termination protocols, supervisory structures, property rights, responsibility frameworks, and prevention and relief measures, for integrating AI as a legal subject.
