19/07/2024 - Court Recap: Emotional Perception AI vs. UK Patent Office (UK)

argument: Decisioni/Decisions - Intellectual Property Law

According to an article from Mondaq, the case of Emotional Perception AI v. Comptroller-General of Patent, Designs and Trade Marks involves a patent application for an AI-based media recommendation system. Initially rejected, the application was allowed on appeal, with the Court of Appeal's judgment pending. The patent, related to artificial neural networks (ANNs), faced exclusion under the Patent Act 1977 as a mathematical method and computer program. The High Court ruled that the ANN, being more than an abstract algorithm, constituted a technical contribution, thus allowing the appeal. This ruling impacted UKIPO practice regarding ANNs.
