According to an article on Staffing Industry, a federal judge has allowed a class action lawsuit against Workday to proceed. The case alleges that Workday’s AI-driven hiring tools discriminate against applicants based on race, age, and disability. The lawsuit, initiated by Derek Mobley, claims the algorithmic screening system disproportionately disqualified Black, older, and disabled applicants. The U.S. Equal Employment Opportunity Commission (EEOC) supports the plaintiff, asserting that Workday's AI tools perform functions similar to traditional employment agencies, thus falling under anti-discrimination laws. Workday maintains that it is not an employment agency and cannot be held liable for bias in its software.
